Scooper Heroes Terms of Service

These Terms of Service govern your access to and use of Scooper-Heroes.com and any quote, scheduling, dog waste removal, lawn treatment, or related service offered by Scooper Heroes. By using the website, requesting a quote, scheduling service, or purchasing a service, you agree to these terms.

Eligibility and Authority

You must be at least 18 years old and legally able to enter into a binding agreement. If you request service for a property you do not own, you represent that you have permission from the owner or authorized occupant.

Quotes, Service Areas, and Scheduling

Website descriptions, ZIP-code checks, and initial estimates do not guarantee availability or a final price. Service depends on the exact property address, route capacity, yard condition, number of dogs, access, requested frequency, and selected services. A booking is confirmed only when Scooper Heroes accepts the request and provides confirmation.

Arrival times may be estimates rather than guaranteed appointments. Weather, unsafe conditions, traffic, route changes, property access, and other circumstances may require rescheduling or cancellation.

Customer Responsibilities and Property Access

You agree to provide complete and accurate contact, property, pet, gate, and billing information. Before each visit, you are responsible for:

• Providing safe and lawful access to every area included in the service.
• Keeping gates unlocked or providing current access instructions.
• Securing pets when requested and informing us about animal behavior or safety concerns.
• Removing or identifying hazards, hidden obstacles, waste other than ordinary dog waste, and areas that should not be entered.
• Maintaining the property so it can be serviced without unreasonable risk to people, animals, or equipment.

If access is unavailable or conditions are unsafe, the visit may be skipped, rescheduled, or charged according to the service arrangement disclosed to you.

Scope and Condition of Service

Scooper Heroes will perform the services described in the accepted quote or service confirmation. Dog waste removal does not guarantee removal of waste that is hidden, inaccessible, frozen, covered by leaves or debris, or located outside the agreed service area. Lawn treatments and deodorizing services may reduce odors or improve conditions but do not guarantee a particular result.

You must report a service concern promptly and provide a reasonable opportunity for Scooper Heroes to inspect or address it. Any satisfaction promise is subject to the scope, timing, and conditions communicated with the applicable service.

Prices, Billing, and Payment

You agree to pay the price, taxes, fees, and other charges disclosed when service is confirmed. Prices may change when property conditions or information differ materially from what was provided, when the requested scope changes, or after advance notice for future recurring visits.

If you provide a payment method, you authorize Scooper Heroes and its payment processor to charge amounts due under your service arrangement. Failed or reversed payments may result in additional lawful charges, suspension, or cancellation of service.

Cancellations, Pauses, and Recurring Service

Cancellation, pause, rescheduling, and refund terms may be stated in your quote, confirmation, invoice, or recurring service arrangement. You are responsible for providing notice through the contact method and within the time period communicated to you. Ending recurring service does not eliminate charges already incurred.

Email, Calls, and Text Messages

By providing your contact information, you agree that Scooper Heroes may contact you about quotes, appointments, service, billing, support, and other transactional matters. Where you separately consent to marketing messages, you may withdraw that consent at any time. Reply STOP to opt out of marketing text messages or email scooperheroes.service@gmail.com. Message and data rates may apply. Consent to marketing is not a condition of purchase.

Website Use and Intellectual Property

The website, branding, text, graphics, logos, photographs, videos, and other content are owned by or licensed to Scooper Heroes and are protected by applicable laws. You may use the website for personal, noncommercial purposes related to learning about or purchasing our services. You may not interfere with the website, attempt unauthorized access, introduce harmful code, scrape content at scale, impersonate another person, or use the website unlawfully.

Third-Party Services and Links

The website may link to or use third-party services for scheduling, payments, forms, analytics, communications, or other functions. Scooper Heroes is not responsible for third-party websites or services outside its control. Your use of those services may also be governed by their terms and privacy policies.

Disclaimers

To the fullest extent permitted by law, the website is provided on an “as is” and “as available” basis. Scooper Heroes does not warrant uninterrupted access, error-free content, or that every service will be available at every address. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by law, Scooper Heroes will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website or services. Scooper Heroes' aggregate liability for a claim relating to a paid service will not exceed the amount you paid for the service giving rise to that claim, except where applicable law does not permit that limitation.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Scooper Heroes harmless from third-party claims, damages, or expenses arising from your unlawful use of the website, your violation of these terms, inaccurate property or safety information, or your lack of authority to request service at a property.

Suspension and Termination

Scooper Heroes may refuse, suspend, or end access to the website or services for nonpayment, unsafe conditions, abusive or unlawful conduct, repeated access problems, misuse of the website, or another material violation of these terms. Provisions that logically survive termination will remain in effect.

Governing Law and Disputes

These terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Before filing a legal claim, you and Scooper Heroes agree to make a good-faith effort to resolve the issue informally by contacting the other party. Any dispute that is not resolved informally will be handled by a court with lawful jurisdiction, unless the parties agree to another process in writing.

Changes to These Terms

Scooper Heroes may update these terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of the website or services after an update means you accept the revised terms to the extent permitted by law.

Severability and Entire Agreement

If any provision is found unenforceable, the remaining provisions will remain in effect. These terms, together with the accepted quote, service confirmation, invoice, Privacy Policy, and any service-specific terms provided to you, form the agreement concerning the website and services.
